<p>In Italia, il programma nazionale di appalti pre-commerciali (PCP) sta crescendo anno dopo anno sia in termini di qualità che di intensità. Questo grazie all’opera costante dell’Agenzia per l’Italia Digitale che, operando in collaborazione con il Ministero dell’Istruzione, stazione appaltante del programma, ha attivato circa diciannove progetti pre-commerciali, trasformando il Bel Paese in uno dei più attivi Stati Membri in questo settore molto caro alla Commissione Europea.<br />
Tuttavia questa tipologia d’appalto non è stata esente da critiche e dubbi da parte degli addetti ai lavori. Difatti, data la peculiare natura di questi appalti, che prevede una divisione di costi e risultati tra stazione appaltante ed operatori di mercato, di fatto li esclude dal Codice degli Appalti e delle Concessioni.<br />
Ai sensi dell’articolo 158 del D.Lgs 50/2016 sono esclusi dall’applicazione del suddetto Codice tutti quegli appalti di ricerca e sviluppo il cui costo di prestazione non è interamente pagato dalla stazione appaltante ovvero quegli appalti il cui risultato non appartiene completamente alla stazione appaltante. L’esclusione dal codice concede pertanto all’appalto pre-commerciale un’elasticità del tutto estranea agli appalti “classici”.<br />
Proprio questa elasticità ha allertato il mondo burocratico e non, costringendo il Presidente dell’Autorità Nazionale Anticorruzione ad intervenire sul tema per fare chiarezza sui confini in cui ci si muove quando si parla della suddetta tipologia d’appalto, al fine di evitare sfruttamenti fraudolenti o impropri dello strumento derivanti dall’esclusione dal codice.<br />
Il Presidente Cantone ha voluto chiarificare inanzitutto la natura dell’oggetto di un appalto pre-commerciale: la ricerca e sviluppo in oggetto deve avere natura aleatoria in termini di risultato. Appalti caratterizzati da un risultato certo e ripetibile non dovrebbero pertanto rientrare nella categoria esclusa. Inoltre, Cantone ha voluto richiamare gli ambiti di applicazione del PCP elencati nel dall’art. 19, comma 1 del d.l. 18 ottobre 2012, n. 179, aggiungendo poi come un ulteriore utilizzo possa essere implementato in altri settori purchè rimanga “un utile, efficace e legittimo strumento di incentivo per lo sviluppo delle conoscenze scientifiche e tecnologiche, in modo da soddisfare con i minor costi possibili e i tempi più rapidi esigenze pubbliche che non potrebbero essere altrimenti soddisfatte”.<br />
Il comunicato di Cantone ha certamente tracciato la linea dell’Autorità sulla realtà pre-commerciale italiana, suscitando tuttavia polemiche su alcune terminologie e fattispecie utilizzate, espresse da noti ricervcatori di settori sull’altrettanto noto ForumPa, luogo d’incontro degli addetti ai lavori in tema di Pubblica Amministrazione.</p>

<p style="text-align: justify">Whistleblower program is surely one of the most debated method to fight corruption and anticompetitive behaviours. All around the world several countries have had, and still have problems to implement it. Since it was created, the program has been branded as too aggressive and criticized for undermining corporations’ internal reports. In this respect, the U.S SEC have addressed to critics publishing figures and features of awards’ recipients of 2016, underlying how approximately 80% of them raised concerns internally to supervisors or compliance personnel, or understood these personnel were aware of the violations, before bringing their concerns to the SEC.1 Moreover, in fiscal year 2016 almost 25% of award recipients reported their concerns anonymously, which is the best protection against retaliation and potential blacklisting, as SEC want to stress.</p>
<p style="text-align: justify">Last but not least, in order to give an answer to those who accuse the program to be too aggressive, could be instructive to report the declaration of Assistant Attorney General Lanny Breuer, which speaking at the national conference on the FCPA said: “I am aware that, for some of you, as we have become more aggressive, you have become more worried. I want to tell you this afternoon that you are right to be more concerned.”2</p>

<p style="text-align: justify;">Pondering about whistleblower program, one may ask himself if it is really effective in practice. Moreover, would be interesting to understand which benefits has really brought to countries which have adopted it.</p>
<p style="text-align: justify;">A virtuous example that could be taken as a model come from the United States. Since the Program came into effect in August 2011<a href="#_ftn1" name="_ftnref1">[1]</a>, the U.S Security and Exchange Commission has awarded several millions of dollars to whistleblowers, starting with the first award of 50,000 USD, issued in 2012<a href="#_ftn2" name="_ftnref2">[2]</a>, up to the astonishing total amount of more than $ 130 million in 2016.<a href="#_ftn3" name="_ftnref3">[3]</a> Only to give an idea, it is useful to know that a whistleblower could be awarded with a percentage of the money recovered that range from 10 percent to 30 percent, which means tons of dollars impounded from wrongdoers. Since there are still many skeptics, is interesting to report the declaration of Jane Norberg, chief of the SEC’s Office of the Whistleblower, after having awarded a whistleblower of $ 20 million in 2012: “<em>This whistleblower alerted us with a valuable tip that led to a near total recovery of investor funds. Sizeable awards like this one should encourage whistleblowers everywhere that there are real financial incentives to promptly reporting potential securities law violations to the SEC</em>.”</p>
<p style="text-align: justify;">Moreover, annual reports from the Office of the Whistleblower reveals the growing power and increasing magnitude of the program to fight corruption.</p>
